Why Medicare Claims Are Denied
Medicare denies claims for several reasons:
- The service is determined not medically necessary
- The provider isn't enrolled in Medicare
- The service isn't covered under Medicare
- Billing errors (incorrect codes, missing information)
- Coverage coordination issues
Important: Many initial denials are reversed on appeal. Medicare beneficiaries who appeal have a meaningful success rate β particularly for medical necessity denials where your doctor supports the treatment.
The 5 Levels of Medicare Appeal
Medicare has five levels of appeal, each escalating to a higher authority:
- Redetermination β Request within 120 days of denial. Medicare contractor reviews the claim. Decision within 60 days.
- Reconsideration β If denied, escalate to a Qualified Independent Contractor (QIC). Decision within 60 days.
- Office of Medicare Hearings and Appeals (OMHA) β Request within 60 days. An Administrative Law Judge reviews your case. Requires at least $180 in disputed claims (2026).
- Medicare Appeals Council β Request within 60 days of OMHA decision.
- Federal Court β Final appeal option for claims above $1,870 (2026).
How to File a Level 1 Redetermination
When you receive a Medicare Summary Notice (MSN) showing a denied claim:
- Circle the denied service on your MSN
- Write a letter explaining why you believe Medicare should cover the service
- Include your Medicare number, the date of service, and the claim number
- Attach supporting documentation β especially a letter from your treating physician
- Mail to the address shown on your MSN within 120 days
A letter from your doctor explaining medical necessity is your strongest tool at the redetermination level. If your doctor believes the treatment was necessary, get that documented clearly.
